Felon overdoses in Burger King, trespasses, faces more charges

Lacey Police Department responded to a call concerning an overdose at a Burger King located on Marvin Road NE on Tuesday, December 5

Upon arrival, responding officers discovered a male, later identified as Nicholas Bournes, on the restaurant floor, with a citizen performing CPR on the suspect after having recently administered naloxone to him.

“We observed the man’s eyes were open and he had a pulse; we advised the citizen to stop performing CPR,” police stated in their report.

As officers approached the man, they noticed a spring-loaded switchblade clipped to the waistband of his sweatpants and removed it immediately.

Further identification revealed the suspect’s identity as a convicted felon on active Department of Corrections (DOC) status.

As the suspect regained consciousness, authorities instructed him to sit down.

Police confronted the man about a pistol reportedly removed by restaurant staff and the switchblade found in his pocket, but he denied any firearm possession.

 Authorities asked the man about his felony status, to which he admitted being on parole.

Authorities once again asked the man to sit down, but he attempted to flee by running south through the parking lot. Officers pursued the suspect and ended up in a building on the north side of the Maple Court enhanced shelter, formerly Days Inn.

The suspect entered a room through an open window before entering an adjoining room.

“A staff member then approached us, stating the suspect had run into the complex through the window of one of the units, and they were tracking him on the security cameras,” Lacey Police reported.

One of the officers was able to locate the suspect and make an arrest.

Maple Court staff confirmed that Bournes trespassed.

After arresting Bournes, the officers returned to take statements from witnesses at the restaurant, where witnesses confirmed that, fearing for safety, they had removed a firearm tucked into the suspect’s waistband and secured it in a safe in the kitchen.

The weapon is a Glock airsoft BB gun.

“The BB gun had a 16-round magazine filled with 9mm live ammunition that was loaded into the gun,” Lacey Police stated.

Inside the police vehicle, the suspect banged his head against the patrol vehicle's partition and window, reportedly screaming, "I can`t breathe" and "I want medical attention!"

Police asked Lacey Fire Department for assistance.

While being attended to, the suspect continued to scream and was uncooperative, prompting the fire department to conclude that the suspect did not need medical attention.

The suspect was transported to Thurston County Jail and was booked for felon in possession of a firearm and residential burglary.

Due to his actions, additional charges of obstruction of a law enforcement officer and possession of a dangerous weapon are being referred to the City Attorney’s office.
