Since the legal noticing requirements weren’t fulfilled, the Thurston County Board of County Commissioners (BoCC) postponed a scheduled public hearing on a proposed ordinance that would allow the county to transfer, lease, or dispose of surplus public land for affordable housing.
The hearing, initially planned for Tuesday, May 6 at 3:30 p.m., was rescheduled to 3:30 p.m. on Tuesday, May 20.
Clerk of the Board Amy Davis disclosed the incomplete legal notice during the BoCC’s agenda setting session on the morning of the initial public hearing day, Tuesday, May 6.
“If I may, address this item, it was brought to our attention that the legal noticing requirements were not completely met for this, and we are shifting the public, or we recommend to shift the public hearing to May 20 to allow for proper noticing,” Davis said.
The board accepted the recommendation and approved the new hearing date. The online announcement is now reflected and posted on the county’s official website.
The proposed ordinance under consideration would authorize the BoCC to amend Chapter 2.104 of the Thurston County Code to align with Washington state law RCW 39.33.015. This would permit the commissioners to transfer, lease, or dispose of real property no longer needed for public service, as long as it serves a “public benefit.”
In this case, the “public benefit” is narrowly defined as affordable housing for low-income and very low-income households, consistent with definitions in RCW 43.63A.510.
Residents will still be able to participate in the hearing process.
Written public comment for the May 20 hearing will be accepted up to two hours before the scheduled meeting starts.
